Terms of Use

1. Agreement

These Terms of Use (“Terms”) are between you and Accelara AI Solutions Limited (“Daymark”, “we”, “us”, or “our”). They apply when you download, access, purchase, or use the Daymark iPhone app.

Your license to use Daymark is also governed by Apple’s Licensed Application End User License Agreement (Standard EULA), which is incorporated into these Terms. If these Terms conflict with the Standard EULA, the Standard EULA controls to the extent of the conflict. Mandatory consumer rights in your country remain unaffected.

2. What Daymark provides

Daymark is a local-first focus timer and session ledger. With your permission, it uses Apple’s Screen Time frameworks to shield apps, categories, or websites that you select during focus sessions. Daymark also provides Focus Cards, scheduled windows, timed breaks, local reminders, and on-device insights.

3. Eligibility and permitted use

You must be legally able to agree to these Terms. If you are not old enough to enter a binding agreement where you live, a parent or guardian must approve your use.

You may use Daymark only for lawful, personal purposes. You must not:

• copy, modify, distribute, resell, or reverse engineer Daymark except where law permits;
• interfere with the app, Apple frameworks, or another person’s device;
• use Daymark to violate law or another person’s rights; or
• misrepresent your relationship with Daymark or Accelara AI Solutions Limited.

4. Screen Time permissions and device behavior

App shielding requires Screen Time authorization and compatible Apple system services. You choose which apps, categories, and websites to shield and may revoke permission in iOS Settings. Daymark cannot guarantee uninterrupted operation because iOS, device settings, permissions, system updates, restarts, and Apple service behavior are outside our control.

You remain responsible for your device, your selections, and verifying that a focus session has started or ended as expected.

5. Subscriptions and billing

Daymark may offer weekly and annual auto-renewable subscriptions. The exact product, duration, trial eligibility, localized price, and included features shown in the app and Apple purchase sheet apply to your purchase.

• Payment is charged to your Apple Account after you confirm the purchase.
• Your subscription renews automatically for the displayed period unless you cancel it through Apple.
• Cancellation takes effect at the end of the current paid period; deleting Daymark does not cancel a subscription.
• If a free trial is offered, it converts to the displayed paid subscription unless cancelled before the trial ends.
• You can manage or cancel a subscription in your Apple Account subscription settings.
• Refunds, billing disputes, price changes, taxes, and payment processing are handled under Apple’s terms and applicable law.
• “Restore purchases” asks Apple to restore eligible entitlements associated with your Apple Account.

6. Ownership

Daymark, including its design, software, text, branding, and other materials, is owned by Accelara AI Solutions Limited or its licensors and is protected by intellectual-property law. The limited license in the Standard EULA does not transfer ownership to you.

Your Focus Cards, selections, and session records remain yours and are stored locally as described in the Privacy Policy.

7. Updates, availability, and changes

We may update, improve, suspend, or discontinue features, subject to applicable law. Updates may be required for compatibility, security, or continued operation. We do not promise that every feature will be available on every device, iOS version, country, or App Store storefront.

8. Disclaimers and liability

To the maximum extent permitted by law, Daymark is provided “as is” and “as available”. The warranty disclaimers and liability limits in Apple’s Standard EULA apply. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, or any mandatory warranty, remedy, or consumer right available where you live.

9. Suspension and termination

You may stop using Daymark at any time. Your license may terminate if you materially violate these Terms or the Standard EULA. Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive. Subscription cancellation remains subject to Apple’s process.

10. Governing terms and disputes

The governing-law and dispute provisions in Apple’s Standard EULA apply, together with any mandatory protections and courts available to you under the law of your usual residence. Before starting a formal claim, you may contact us so we can try to resolve the issue informally.

11. Changes to these Terms

We may update these Terms to reflect changes to Daymark, Apple services, or legal requirements. We will publish the updated Terms here and revise the effective date. If a change materially affects existing users, we will provide additional notice where appropriate. Continued use after the change becomes effective constitutes acceptance where permitted by law.
